Terms of Service

Effective June 27, 2026

By accessing or using Geneviva ("the Service") at genevia.app, you agree to these Terms. If you do not agree, do not use the Service.

Beta period

Geneviva is currently in beta. The Service is provided free of charge during beta. We may modify, limit, or discontinue features during this period. We will provide reasonable notice before any significant changes.

Your account

  • You must be at least 13 years old to use Geneviva.
  • You are responsible for all activity under your account.
  • Keep your credentials secure. Notify us immediately of any unauthorized access.

Your content

You retain full ownership of the family data, photos, and stories you upload. By uploading content, you grant Geneviva a limited license to store and display that content to you and the family members you invite — nothing more. We do not claim ownership of your content and will not use it for any other purpose.

You are responsible for ensuring you have the right to upload any content you add, including photos of other people.

Acceptable use

You agree not to:

  • Upload content that is illegal, harmful, or violates a third party's rights.
  • Attempt to access another user's tree without an invitation.
  • Scrape, reverse-engineer, or exploit the Service.
  • Use the Service for commercial genealogy resale without written consent.

Privacy

Our Privacy Policy explains how we handle your data. By using the Service, you agree to that policy.

Termination

You may delete your account at any time via our Delete Data page. We may suspend or terminate accounts that violate these Terms. Upon termination, your data will be deleted immediately per our Privacy Policy.

Disclaimers

The Service is provided "as is" during beta. To the extent permitted by California law, we disclaim implied warranties of merchantability and fitness for a particular purpose. We do not warrant uninterrupted or error-free availability. Nothing in this section limits any rights you may have under California consumer protection laws that cannot be waived by contract.

Limitation of liability

To the maximum extent permitted by applicable law, Geneviva's total liability to you for any claim arising from use of the Service is limited to the greater of: (a) the amount you paid us in the three months preceding the claim, or (b) $100 USD. During the free beta period, this means $100 USD. This limitation does not apply to liability arising from our gross negligence or willful misconduct, or to any liability that cannot be limited under California law.

Dispute resolution

We'd prefer to resolve any dispute informally first. Email us at hello@genevia.app and we will try to resolve the issue within 30 days. If we can't, either party may bring a claim in small claims court in Los Angeles County, California, or pursue any other remedy available under California law. Nothing in these Terms prevents you from seeking public injunctive relief as permitted under California law (see McGill v. Citibank).

California consumer rights

Under California Civil Code § 1789.3, California residents are entitled to the following specific consumer rights notice: The Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs may be contacted in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210.

Future paid plans (California Automatic Renewal Law)

Geneviva is currently free during beta. If we introduce paid subscriptions, we will comply with the California Automatic Renewal Law (Bus. & Prof. Code § 17600 et seq.), including providing clear disclosure of recurring charges, easy cancellation, and required notices before any free trial converts to a paid plan.

Changes

We may update these Terms. We will notify you by email or prominent in-app notice at least 30 days before material changes take effect. Continued use after that date constitutes acceptance.

Governing law

These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-law provisions. You consent to personal jurisdiction in the state and federal courts located in Los Angeles County, California.

Nothing in these Terms limits any rights you may have under the EU General Data Protection Regulation (GDPR), the UK GDPR, or other applicable data protection laws that cannot be waived by contract. Users in the EEA and UK may also have rights under their local consumer protection legislation.
